Welcome to White Roof B&B. This Website is provided solely to assist customers in gathering vacation rental information, determining the availability of related goods and services, making legitimate personal rental inquiries, secure bookings and process payments for such rental bookings. Use of the Website for any other purpose is strictly prohibited. The terms "we", "us", "our" and "White Roof B&B" refers to White Roof B&B.com. The term "you" refers to the customer visiting the Website and or contributing content on this Website. White Roof B&B is totally aware of the Standard of Electronic Transaction Act 1999 which was published in the Official Gazette as Government Notice No.309 dated May 5th 2000.
This Website is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "Agreement"). By accessing or using this Website in any manner, you agree to be bound by the Agreement. Please read the Agreement carefully. If you do not accept all of these terms and conditions, please do not use this Website. You may not amend this Agreement. Be sure to return to this page periodically to review the most current version of the Agreement. We reserve the right at any time, at our sole discretion, to change or otherwise modify the Agreement without prior notice, and your continued access or use of this Website signifies your acceptance of the updated or modified Agreement.
The Site is a venue and WE ARE NOT A PARTY TO ANY RENTAL AGREEMENTS OR TRANSACTIONS
We urge all users to be responsible about their use of this Website and any transaction entered into as a result of either listing a property or renting a property. We do not own or manage, nor can we contract for, any vacation rental property listed on the Website. White Roof B&B acts as a venue to allow homeowners and property managers who advertise on the Website (each, a "Manager") to offer for rent specific vacation rental properties to potential renters, including various ways for users to communicate with one another and enter into rental agreements or rental transactions.
We are not a party to the rental or other agreement between users. Any part of an actual or potential agreement between users, including the quality, condition, safety or legality of the properties advertised, the accuracy of the listing content, the ability of homeowners to rent a vacation property or the ability of renters to pay for vacation rental properties are solely the responsibility of each user. You acknowledge and agree that you may be required to enter into a separate rental agreement with the Manager prior to making a booking or purchasing a product or service and such agreement may place additional restrictions on your booking, product or service.
Users agree that they are responsible for and agree to abide by, all laws, rules and regulations applicable to their use of the Site, their use of any tool, service or product offered on the Site and any transaction they enter into on the Site or in connection with their use of the Site. Users further agree that they are responsible for and agree to abide by all laws, rules, regulations or other requirements relating to taxes, credit cards, data and privacy, license requirements, safety compliance, compliance with all anti-discrimination listed on the Site.
USE OF THE WEBSITE
As a condition of your use of this Website, you warrant that (i) you are at least 18 years of age, (ii) you possess the legal authority to create a binding legal obligation, (iii) you will use this Website in accordance with this Agreement, (iv) you will only use this Website to make legitimate reservations for you or for another person for whom you are legally authorized to act, (v) all information supplied by you on this Website is true, accurate, current and complete, and (vi) if you have a White Roof B&B account, you will safeguard your account information and will supervise and be completely responsible for any use of your account by anyone other than you. We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of this Agreement.
USER VERIFICATION
You agree to (i) keep your password and online ID for both your account with us and any personal email account associated with your account secure and strictly confidential, providing it only to authorized users of your accounts, (ii) instruct each person to whom you give your online ID and password that he or she is not to disclose it to any unauthorized person, (iii) notify us immediately and select a new online ID and password if you believe your password for either your account with us or your email account may have become known to an unauthorized person, and (iv) notify us immediately if you are contacted by anyone requesting your online ID and password. We discourage you from giving anyone access to your online ID and password for your account with us and your email account. However, if you do give someone your online ID and online password, or if you fail to adequately safeguard such information, you are responsible for any and all transactions that the person performs while using your account with us or your email account, even those transactions that are fraudulent or that you did not intend or want performed.
EACH USER ACKNOWLEDGES AND AGREES THAT: White Roof B&B WILL HAVE ANY LIABILITY TO ANY USER FOR ANY UNAUTHORIZED TRANSACTION MADE USING ANY USER'S PASSWORD; AND (2) THE UNAUTHORIZED USE OF YOUR ONLINE ID AND PASSWORD FOR YOUR WHITE ROOF B&B ACCOUNT OR YOUR EMAIL ACCOUNT COULD CAUSE YOU TO INCUR LIABILITY TO BOTH White Roof B&B AND OTHER USERS. Further, we may, without notice to you, suspend or cancel your listing at any time even without receiving notice from you if we suspect, in our sole discretion, that your account with us or your email account is being used in an unauthorized or fraudulent manner.
Responsibility for Property and Traveler Liability
We do not provide liability insurance protection for owners, or travelers. Users are solely responsible for obtaining insurance coverage sufficient to protect their properties and guests or their trip.
REVIEWS, COMMENTS AND OTHER SUBMISSIONS
We appreciate hearing from you. Please be aware that by submitting content to this Website by electronic mail, postings on this Website or otherwise, including any vacation home rental reviews, questions, comments, suggestions, ideas or the like contained in any submissions (collectively, "Submissions"), you grant White Roof B&B and its affiliates a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sub licensable right to (a) use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Submissions throughout the world in any media, now known or hereafter devised; (b) use the name that you submit in connection with such Submission. You acknowledge that White Roof B&B may choose to provide attribution of your comments or reviews (for example, listing your name and hometown on a vacation home rental review that you submit) at our discretion.
You are fully responsible for the content of your Submissions, (specifically including, but not limited to, reviews posted to this Website). You are prohibited from uploading, posting or transmitting or otherwise publishing to or from this Website any of the following:
a. Any message, data, information, text, music, sound, photos, graphics, code or other material ("Content") that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable;
b. Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
c. Content that may infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party;
d. Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity;
e. Unsolicited promotions, political campaigning, advertising or solicitations;
f. Private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers;
g. Viruses, corrupted data or other harmful, disruptive or destructive files; or
h. Content that, in the sole judgment of White Roof B&B, is objectionable or which restricts or inhibits any other person from using or enjoying the Interactive Areas or the Site, or which may expose White Roof B&B or its affiliates or its users to any harm or liability of any type.
You shall be solely liable for any damages resulting from any violation of the foregoing restrictions, or any other harm resulting from your posting of content to this Website. You acknowledge that White Roof B&B may exercise its rights (e.g. use, publish, delete, edit and modify) to any content you submit without notice to you.
White Roof B&B takes no responsibility and assumes no liability for any Content posted, stored or uploaded by you or any third party, or for any loss or damage thereto, nor is liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter.
INDEMNIFICATION.
In the event that you have a dispute with one or more other users of the site (including, without limitation, any dispute between users regarding any transaction or user contributed content) or any third party provider or any third party website that may be linked to or from or otherwise interact with the site, including without limitation any social media site, you hereby agree to release, remise and forever discharge each member of the White Roof B&B , each of their respective agents, directors, officers, employees, and all other related persons or entities from any and all manner of rights, claims, complaints, demands, causes of action, proceedings, liabilities, obligations, legal fees, costs, and disbursements of any nature whatsoever, whether known or unknown, which now or hereafter arise from, relate to, or are connected with such dispute and/or your use of the site. You hereby agree to indemnify, defend and hold each member of the White Roof B&B (collectively, the "indemnified parties") harmless from and against any and all liability and costs incurred by the indemnified parties in connection with any claim arising out of your use of the site or otherwise relating to the business we conduct on the site INDEMNIFICATION (including, without limitation, any potential or actual communication, transaction or dispute between you and any other user or third party), any content posted by you or on your behalf or posted by other users of your account to the site, any use of any tool or service provided by a third party provider, any use of a tool or service offered by us that interacts with a third party website, including without limitation any social media site or any breach by you of these terms or the representations, warranties and covenants made by you herein, including without limitation, attorneys' fees and costs.
LINKS TO THIRD-PARTY SITE
Application and Services may contain links to third-party websites or resources. We are not responsible or liable for the availability or accuracy of such websites or resources, the content, products, or services on or available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources or the content, products or services on or available from such websites or resources.
Payment Terms. You agree to pay White Roof B&B, acting on behalf of the Host for the Total Fee (subject to any Scheduled Payments, discussed below) for any booking at the time you accept a payment request received from a Host. The Total Fee will be collected in accordance with this Agreement and the pricing terms specified in the booking request.
When you complete a rental booking request, you will be asked to provide your billing information, including your name, billing address and credit card information either to White Roof B&B or its third party payment processor. You agree to pay White Roof B&B for any confirmed bookings made in connection with your vacation rental booking in accordance with this Agreement by one of the methods described on the Website. You hereby authorize the collection of such amounts by charging the credit card provided as part of requesting the booking, either directly by White Roof B&B or indirectly, via a third party online payment processor or by one of the payment methods described on the Website.
Cancellations and Refunds. As a Guest, if you wish to cancel a confirmed booking made via our Website, the cancellation policy of the Manager contained in the applicable Listing will apply to and govern the terms of your cancellation and any refunds.
HURRICANE POLICY
We do not offer any refunds for Hurricanes or Tropical Storms. We recommend getting Travel Insurance for your vacation. It is up to the Guest to purchase this coverage.
ACTS OF GOD: We shall not be liable for events beyond our control which interfere with Your scheduled occupancy, including, but not limited to, Acts of God, acts of government agencies, fire, strikes, war, severe weather, inclement weather, loss of electricity or loss of water. NO REBATE OR REFUND shall be given in these circumstances.
We do not provide refunds on appliance or air conditioning breakdowns. We and our owners try to keep these items in good working order, and we will have any failures fixed as quickly as possible after they are reported to us.
We do not provide refunds for inclement weather, including hurricanes or other causes of mandatory evacuations during your stay. For your financial protection, we recommend you purchase Trip Cancellation Insurance in case either your personal situation or the weather interrupts your scheduled vacation.
Modification
White Roof B&B reserves the right, at its sole discretion, to modify the Site, Application or Services or to modify these Terms, including the Service Fees, at any time and without prior notice. If we modify these Terms, we will post the modification on the Site or via the Application or provide you with notice of the modification. By continuing to access or use the Site, Application or Services after we have posted a modification on the Site or via the Application or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Site, Application and Services.
As a Host, you understand and agree that White Roof B&B does not act as an insurer or as your contracting agent. If a Guest requests a booking of your Accommodation and stays at your Accommodation, any agreement you enter into with such Guest is between you and the Guest. Notwithstanding the foregoing, White Roof B&B Payments serves as the limited authorized payment collection agent of the Host for the purpose of accepting payments from Guests of such amounts stipulated by the Host.
Each Host hereby appoints White Roof B&B Payments as the Host’s limited payment collection agent solely for the purpose of accepting the Accommodation Fees from Guests.
Each Host agrees that payment made by a Guest through White Roof B&B Payments, shall be considered the same as a payment made directly to the Host, and the Host will make the Accommodation available to the Guest in the agreed-upon manner as if the Host has received the Accommodation Fees. Each Host agrees that White Roof B&B may, in accordance with the cancellation policy reflected in the relevant Listing, permit the Guest to cancel the booking and refund to the Guest that portion of the Accommodation Fees specified in the applicable cancellation policy. Each Host understands that as White Roof B&B accepts payments from Guests as the Host’s limited payment collection agent and that White Roof B&B obligation to pay the Host is subject to and conditional upon successful receipt of the associated payments from Guests. Only successfully received payments from Guests will be paid to Hosts. In accepting appointment as the limited authorized agent of the Host, White Roof B&B assumes no liability for any acts or omissions of the Host.
Rental Agreements. By utilizing a rental agreement in White Roof B&B Payments, users the Guest agree to the terms and conditions set forth in the rental agreement (including without limitation the cancellation refund policy) effective as of the date that the user indicates acceptance of the rental agreement. You hereby acknowledge and agree that (a) you are fully responsible for reviewing and complying with the terms and conditions of the rental agreement, (b) any rental agreement used, whether a sample provided by the Website or a rental agreement added by either party, is used solely at their own risk and expense, (c) nothing contained in your White Roof B&B account, this Agreement, or any sample rental agreement is a substitute for the advice of an attorney, (d) your rental agreement for the Listing is with the home Owner, not White Roof B&B, and that you shall not hold White Roof B&B responsible for any acts or omissions of the home Owner relating to the rental transaction, and (e) that you have hereby been advised to obtain local legal counsel to prepare, review and revise as necessary any rental agreements to ensure compliance with federal, state, and local law and their particular circumstances, and to revise the rental agreement as necessary to accurately represent their property, rules and features and circumstances of Guests as applicable. You agree and acknowledge that White Roof B&B is acting as the home Owner's payment agent for the limited purpose of receiving your payment and that payment to White Roof B&B shall be considered the same as a payment to the home Owner.
Bookings and obligations for Guests
The Hosts of the accommodations you booked are solely responsible for honoring any confirmed bookings and making available any accommodations reserved through the site, application and services. If you, as a guest decide to book an accommodation and enter into a transaction with a host for the booking of an accommodation, you agree and understand that you will be required to enter into an agreement with the host and you agree to accept any terms, conditions, rules and restrictions associated with such accommodation imposed by the host. You acknowledge and agree that you will be fully responsible for performing the obligations of any such agreements, that White Roof B&B is not a party to such agreements, and that, with the exception of its payment obligations White Roof B&B disclaims all liability arising from or related to any such agreements. As a guest you agree to pay White Roof B&B for the total fees for any booking requested in connection with your White Roof B&B account White Roof B&B payments will collect the total fees in accordance with these terms and the pricing terms set forth in the applicable listing. Please note that White Roof B&B cannot control any fees that may be charged to a guest by his or her bank related to White Roof B&B’s collection of the total fees, and White Roof B&B disclaims all liability in this regard.
In connection with your requested booking, you will be asked to provide customary billing information such as name, billing address and credit card information either to White Roof B&B payments or its third-party payment processor(s). You agree to pay White Roof B&B for any confirmed bookings made in connection with your White Roof B&B account in accordance with these terms by credit card through our secured Gateway System. You hereby authorize the collection of such amounts by charging the credit card provided as part of requesting the booking, either directly by White Roof B&B payments or indirectly, via a third-party online payment processor or by one of the payment methods described on the site or application. You also authorize White Roof B&B payments to charge your credit card in the event of damage caused by you at an accommodation.
ENTIRE AGREEMENT
These terms constitute the entire and exclusive understanding and agreement between White Roof B&B and you regarding the site, application, services, collective content, and any bookings or listings of accommodations made via the site, application and services, and these terms supersede and replace any and all prior oral or written understandings or agreements between White Roof B&B and you regarding bookings or listings of accommodations, the site, application and services.
